1. About These Terms

These Terms of Service ("Terms") govern your access to and use of the Elumi website and your purchase of products from Elumi ("we," "us," "Elumi"). By using our site or placing an order, you agree to these Terms.

Elumi Wellness is a registered business name of 18267529 Canada Inc.

2. Products and Orders

Elumi sells wearable red and near-infrared light wellness products. Product descriptions, specifications and images are provided for general reference; we make reasonable efforts to keep them accurate and will correct known errors promptly. All orders are subject to acceptance and product availability.

3. Product Use and Safety

Use each Product only as described in the instructions and safety information supplied with the Product. Do not use a Product in a manner that is inconsistent with those instructions or warnings. Nothing in this section limits any right or remedy relating to a defective or unsafe Product.

4. Pricing and Payment

All prices are listed in Canadian dollars (CAD) unless otherwise stated. We reserve the right to correct pricing errors. Payment is processed securely through our payment provider at the time of order.

5. Shipping and Delivery

Shipping and delivery terms are described in Elumi's Shipping Policy and in the information presented at checkout and in your order confirmation. Delivery estimates are estimates unless applicable law requires otherwise. Any charges or restrictions that must be disclosed before purchase will be presented before you complete the order.

6. Returns and Warranty

Elumi's Return & Warranty Policy describes our voluntary return practices and the process for reporting a defective Product. That policy forms part of these Terms to the extent permitted by law. Where applicable law gives you additional or different rights, those rights prevail.

Statutory Rights and Legal Warranties. Your purchase may be protected by legal warranties and other mandatory consumer rights under the laws that apply where you live. Nothing in these Terms or in Elumi's Return & Warranty Policy excludes, restricts or replaces any right or remedy that cannot lawfully be waived.

7. Governing Law and Consumer Rights

If you are a consumer resident in Quebec, these Terms and any purchase from Elumi are governed by the laws of Quebec and the federal laws of Canada applicable in Quebec. Nothing in these Terms limits any right, remedy or protection that cannot lawfully be waived under Quebec law, and nothing in these Terms prevents a Quebec consumer from bringing a proceeding before a court or authority that has jurisdiction under applicable law.

If you are a consumer resident elsewhere in Canada, these Terms and any purchase from Elumi are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, except that you continue to have the benefit of any mandatory consumer-protection right or remedy that applies to you under the laws of your province or territory of residence.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Elumi will not be liable for indirect, incidental, special or consequential losses arising from use of the Site or Products where those losses may lawfully be excluded.

This liability cap does not apply to, and Elumi does not attempt to limit: any legal or statutory warranty claim, any remedy or right available under applicable consumer protection legislation, liability for bodily or moral injury, liability arising from intentional or gross fault where applicable law prohibits its limitation, or any other right or liability that cannot lawfully be excluded or limited.

For a claim arising solely from a Product purchase that falls outside all of the above — that is, a claim that does not involve a statutory or legal warranty, a consumer-protection remedy, personal injury, fraud, wilful misconduct, or gross negligence — Elumi's aggregate contractual liability will not exceed the amount you paid to Elumi for the Product giving rise to the claim.

Quebec. For consumers resident in Quebec, nothing in this section limits or excludes any remedy available under the Consumer Protection Act (Quebec), including remedies under sections 37, 38, 39 and 272, or any right that cannot be waived under articles 1474, 1437, or other provisions of the Civil Code of Québec.

Ontario and other provinces. For consumers resident in Ontario, nothing in this section limits or negates any implied condition or warranty protected under section 9 of the Consumer Protection Act, 2002 (Ontario) and the Sale of Goods Act (Ontario). Consumers in other provinces and territories retain the benefit of any equivalent non-waivable consumer protection under the laws of their province or territory of residence.

9. Privacy

Elumi's Privacy Policy explains how we collect, use, disclose and protect personal information. The Privacy Policy is separate from these Terms and should be read together with them.

10. Intellectual Property

All content on the Elumi website — including text, graphics, logos, and images — is owned by or licensed to Elumi and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our written permission.

11. Dispute Resolution

We encourage you to contact Elumi first so we can try to resolve any concern promptly. Nothing in these Terms requires you to submit a dispute to arbitration or limits any right you have to bring a claim before a court, tribunal or consumer protection authority that has jurisdiction under applicable law.

12. Changes to These Terms

We may update these Terms from time to time. The version in effect when you place an order will govern that order, except where a change is required by applicable law or is otherwise validly agreed. Updated Terms will apply prospectively from the effective date shown at the top of these Terms.
